By creating an account and using MAX AI Companion, you agree to be bound by these Terms of Service. You must accept these terms before using the app. If you do not agree to these terms, please do not use MAX.

MAX is an AI-powered conversational companion designed for emotional support and casual conversation. MAX is NOT a licensed therapist, counselor, psychologist, psychiatrist, or medical professional. MAX is not a substitute for professional mental health care, medical advice, or emergency services.

You should not rely on MAX for clinical guidance, crisis intervention, or any form of professional care. If you are experiencing a mental health emergency, please contact your local emergency services or a crisis hotline immediately.

All responses from MAX are generated by artificial intelligence (OpenAI). MAX is not a real person. AI-generated responses may be inaccurate, incomplete, or inappropriate despite our safety measures.

MAX's responses do not represent professional opinions, medical advice, legal counsel, or factual claims. You acknowledge that AI technology has inherent limitations and should exercise your own judgment when interpreting MAX's responses.

MAX is designed with strict therapeutic boundaries. MAX will never:

- Provide medical advice, diagnoses, or treatment recommendations. - Suggest, prescribe, or comment on medications. - Act as a substitute for a licensed mental health professional. - Provide crisis counseling or emergency intervention.

These boundaries are enforced through system-level safeguards and cannot be overridden through conversation.

MAX includes safety features that detect messages potentially indicating a crisis. When triggered, MAX will surface local emergency resources and crisis hotlines.

MAX is NOT an emergency service. If you or someone you know is in immediate danger, contact your local emergency services (e.g., 911, 999, or your country's emergency number) or a crisis hotline immediately.

Emergency resources provided by MAX are for informational purposes. We do not guarantee the availability or accuracy of third-party crisis services.

You must be at least 18 years old to create an account and use MAX AI Companion. Age verification is enforced through a server-side date of birth check during registration. By using MAX, you confirm that you are at least 18 years of age.

You agree to use MAX respectfully and in good faith. You acknowledge that:

- MAX may not always provide accurate or appropriate responses. - You are responsible for your own decisions and actions based on conversations with MAX. - You will not attempt to use MAX to generate harmful, illegal, or abusive content. - Content filtering (including NSFW detection) is always active and cannot be disabled.

MAX AI Companion is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

- Your use of or inability to use MAX. - Any decisions or actions taken based on conversations with MAX. - Any unauthorized access to or alteration of your data. - Any interruption or cessation of the service.

We may update these Terms of Service from time to time. Changes will be posted within the app with an updated effective date. Your continued use of MAX after changes are posted constitutes acceptance of the updated terms.

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict of law principles. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of the Republic of the Philippines.
